These Terms and Conditions constitute a legally binding agreement between you and Hello Church LLC ("Hello Church," "we," "us," or "our") concerning your access to and use of myhello.church and any related media, channels, or mobile applications (collectively, the "Site"). We are registered in Colorado, United States with our registered office at 2679 Main St, Littleton, CO 80120. By accessing the Site, you confirm that you have read, understood, and agree to be bound by these Terms. IF YOU DO NOT AGREE, YOU MUST DISCONTINUE USE IMMEDIATELY.

We reserve the right to modify these Terms at any time. Changes are effective upon posting, and your continued use of the Site constitutes acceptance of the revised Terms.

 

1. Eligibility

The Site is intended for users who are at least 18 years old. The Site is not tailored to comply with industry-specific regulations (HIPAA, FISMA, GLBA, etc.). If your use would be subject to such laws, you may not use this Site.

 

2. Intellectual Property

All content on the Site — including text, graphics, logos, software, and trademarks — is owned by or licensed to Hello Church LLC and protected by applicable intellectual property laws. You are granted a limited, non-commercial license to access and use the Site. No content may be copied, reproduced, or commercially exploited without our express written permission.

 

3. User Representations

By using the Site, you represent that: all information you provide is true and accurate; you have the legal capacity to agree to these Terms; you are not a minor in your jurisdiction; you will not access the Site through automated means; and your use will not violate any applicable law.

 

4. User Registration

You may be required to register to access certain features. You are responsible for maintaining the confidentiality of your password and all activity under your account. We reserve the right to remove or reclaim usernames at our discretion.

 

5. Fees and Payment

We accept Visa, Mastercard, American Express, and Discover. Some services may require payment. You agree to provide accurate billing information and authorize us to charge your payment method accordingly. For recurring charges, you consent to automatic billing until cancellation. All payments are in U.S. dollars. We reserve the right to correct pricing errors and refuse any order.

 

6. Cancellation

You may cancel your subscription at any time by logging into your account or contacting us at support@myhello.church. Cancellation takes effect at the end of the current paid term.

 

7. Prohibited Activities

You agree not to use the Site for any purpose other than its intended use. Prohibited activities include but are not limited to:

• Scraping, mining, or compiling data from the Site without written permission

• Fraudulent, deceptive, or misleading activity

• Uploading malware, viruses, or disruptive code

• Impersonating other users or persons

• Unauthorized automated use, scripts, or bots

• Violating any applicable law or regulation

• Using the Site to compete with us or for unauthorized commercial purposes

• Harassing, threatening, or harming other users or our staff

 

8. User Contributions

If you submit content to the Site, you represent that it is accurate, original, non-infringing, lawful, and does not violate the rights of any third party. Any content that violates these Terms may result in suspension or termination of your access.

 

9. Contribution License

You retain ownership of your contributions. By submitting feedback or suggestions, you grant us the right to use them without compensation. We are not liable for any statements made in your contributions, and you agree to hold us harmless regarding them.

 

10. Mobile Application

If you access the Site via a mobile app, you are granted a limited, non-exclusive, non-transferable license to use the app on your device in accordance with these Terms. You may not decompile, reverse engineer, or create derivative works from the app. Additional terms from Apple App Store or Google Play may apply.

 

11. Submissions

Any questions, ideas, or feedback you submit to us become our sole property. We may use submissions for any lawful purpose without acknowledgment or compensation to you.

 

12. U.S. Government Rights

Our services are "commercial items" as defined under FAR 2.101 and are subject to these Terms accordingly.

 

13. Site Management

We reserve the right to monitor the Site for violations, take legal action against violators, remove or restrict content, and manage the Site to protect our rights and ensure proper functioning.

 

14. Privacy Policy

Your use of the Site is also governed by our Privacy Policy at myhello.church/privacy, incorporated herein by reference. The Site is hosted in the United States. By using the Site from outside the U.S., you consent to your data being transferred to and processed in the United States.

 

15. Term and Termination

These Terms remain in effect while you use the Site. We reserve the right to deny access, suspend, or terminate your account at any time without notice or liability. If your account is terminated, you may not re-register without permission.

 

16. Modifications and Interruptions

We reserve the right to modify, suspend, or discontinue the Site at any time without notice. We are not liable for any loss caused by downtime, interruptions, or discontinuance of the Site.

 

17. Governing Law

These Terms are governed by the laws of the State of Colorado, without regard to conflict of law principles.

 

18. Dispute Resolution

Informal Negotiation: Before initiating arbitration, parties agree to attempt informal resolution for at least 30 days via written notice.

Binding Arbitration: Unresolved disputes will be settled by binding arbitration under AAA Commercial Arbitration Rules. YOU WAIVE YOUR RIGHT TO A JURY TRIAL. Arbitration will be conducted in Benton County, Arkansas unless otherwise required by AAA rules. No class action arbitration is permitted.

Exceptions: Disputes involving intellectual property rights, theft, piracy, privacy violations, or injunctive relief are not subject to arbitration.

All disputes must be brought within one (1) year of the cause of action arising.

 

19. Corrections

We reserve the right to correct errors, inaccuracies, or omissions on the Site at any time without prior notice.

 

20. Disclaimer

THE SITE IS PROVIDED "AS-IS" AND "AS-AVAILABLE." TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE ARE NOT LIABLE FOR ERRORS, PERSONAL INJURY, UNAUTHORIZED ACCESS, TRANSMISSION INTERRUPTIONS, MALWARE, OR ANY LOSS ARISING FROM USE OF THE SITE OR THIRD-PARTY CONTENT.

 

21. Limitations of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, OUR LIABILITY FOR ANY CLAIM ARISING FROM YOUR USE OF THE SITE IS LIMITED TO THE LESSER OF THE AMOUNT YOU PAID TO US IN THE SIX (6) MONTHS PRIOR TO THE CLAIM OR $1,000.00 USD. WE ARE NOT LIABLE FOR INDIRECT, CONSEQUENTIAL, INCIDENTAL, OR PUNITIVE DAMAGES.

 

22. Indemnification

You agree to defend, indemnify, and hold harmless Hello Church LLC and its officers, agents, partners, and employees from any claims, damages, or expenses — including reasonable attorneys' fees — arising from your use of the Site, breach of these Terms, or violation of any third-party rights.

 

23. User Data

You are solely responsible for data you transmit to the Site. We are not liable for loss or corruption of your data, and you waive any related claims against us.

 

24. Electronic Communications

By using the Site, you consent to receive electronic communications and agree that electronic agreements, notices, and disclosures satisfy all legal writing requirements.

 

25. California Users

Unresolved complaints may be directed to the California Department of Consumer Affairs, Complaint Assistance Unit, 1625 North Market Blvd., Suite N 112, Sacramento, CA 95834.

 

26. Miscellaneous

These Terms constitute the entire agreement between you and Hello Church LLC. If any provision is found unenforceable, the remaining provisions remain in full effect. No waiver of any term shall be deemed a further waiver. We may assign our rights and obligations at any time. No joint venture, partnership, or agency relationship is created by these Terms.
